Payment
-Full payment must be sent through PayPal, USD ONLY, after the negotiation is complete and before the project begins. Turnaround timeline officially begins after full payment is received.- My standard turnaround time is 30 business days. Pieces can take anywhere from a few hours to a few weeks to complete, and I strive for timely work that maintains a high quality. I highly prioritize regular communication with my clients, and will always provide updates through private messages or publicly on my social media if there are any significant delays beyond 30 business days. If you are ever concerned about the status of your piece, PLEASE reach out!-I'm very happy to discuss payment plans. Payment plans are available by default on pieces over $200, and can be discussed otherwise on a case-by-case basis. (All payment plans will be conducted through PayPal invoices for both my and the client's security.)-I have the right to drop or refuse a project at any time for any reason. If you’ve already paid and I cancel the commission, it will be refunded. If there is a substantial amount of work done on the piece (75% or more completed), a specific solution will be negotiated with the client.-If the project is canceled by the client, only partial refunds are available. I can offer a 50% refund before I begin coloring (painted pieces), lining a piece (lined work, reference sheets), or after the first WIP is accepted (simple scenes). After these benchmarks, no refunds are available due to the time invested on the project.Process
- I do not take surprise gift commissions. As the client you MUST be prepared to present proof that any 3rd parties have consented to the piece being drawn with their characters. Additionally, you must be willing to confirm in writing that they are 18 or older. I want to thank you for considering making my artwork a part of your celebration. For gifts, I can wait to post a piece until after a specific date so there is some mystery for the gift recipient. This must be stated at time of commissioning so I can plan accordingly.-I'm happy to draw mature pieces and can provide examples of such work upon request, but the commissioner must be over the age of 18 to commission any sort of mature material (including but not limited to smoking, drug use, and machine operation). Mature pieces have a non-negotiable 30% fee added to the listed base price. For more information on what Mature artworks entail, please contact me directly with inquiries.-I absolutely love working with folks who don't have visual references for their character! That said, if you can only provide a written description with no visuals, please note that there may be a design fee associated with your commission. This is dependent on the complexity of the character that is described to me, and the extent to which I have artistic liberty. Specificity and photo references/moodboards will reduce the fee, or may negate it entirely! Please be prepared when you commission me!-I retain the right to use discretion when deciding what references I am comfortable gathering inspiration from. I do not accept AI generated images as reference material. If one is provided on purpose, I will decline your project. If one is provided on accident, or if we recognize it as AI later on in the process, I will ask you to find a new reference. Dollmaker / Picrews / etc. are perfectly fine, as always.Edits/Revisions
-Four edits/adjustments are included in each piece with the exception of simple scenes and portraits which have two rounds of feedback (first wip, final checks).-I work on a common sense system, which means that the edit limit doesn't apply to errors made by me – for example, missing a part of a character's design that is clearly displayed on a reference sheet, or a detail clearly conveyed in our negotiations via text.-Any extensive changes past that point may incur a fee ranging anywhere from $5 to the cost of additional backgrounds, characters, et cetera.
If the prompt changes halfway through, or a different pose or outfit is requested and 4 edits have already been made, it will likely be an extra charge for time and effort incurred.-As the artist, I retain the right to use my judgement when accepting or declining and revision after four edits have been made. I want you to be as happy as possible with the art, on a reasonable timeline.-Please ensure all references, descriptions, are set when you commission me! I try to be as flexible as possible, but the piece starts with our conversation, and all decisions I make as an artist begin with that initial description of the work. It’s very exciting when the project changes and adapts with client feedback, it’s my favorite part of the job! However there is only so much I can do if I don’t have all the pieces to the puzzle to start. I’d like to reiterate: please be prepared when you commission me, thank you!Usage
-I may use any project in my portfolio or as advertisement for my work. Additionally, it is up to my discretion if/when I choose to post the artwork. If you specifically need a commission to remain private in perpetuity, you must inform me at the time of commissioning and accept a nonrefundable 25% fee.-You can use the completed piece you purchased in whatever way you want (non-commercial, icon, TTRPG, personal use printing, etc) with attribution to @NoonmarkArt on Bluesky/Twitter, or noonmarkart.dev.-Purchased Commissions are for personal use only -- you cannot market it as your own art or profit from it if you have not purchased commercial licensing. Commercial licensing rates can be discussed on a case-by-case basis and can often range from 15-50% of the initial quote/price depending on the usage requested.-If you have not attained permission from the purchaser, you may NOT use my art for any reason.-You may not erase or edit out my signature/watermark.-I retain the copyright to all completed artwork, work-in-progress artwork and materials created by me in the process of the project. As such, unfinished artwork (WIPs, unused concept art, etc) may not be provided to another artist to complete. I do not claim copyright to the client’s intellectual property, work, etc.-I retain the right to repurpose unfinished work, concept sketches, etc for YCHs or other pieces. All client-owned intellectual property would be removed in such a scenario.-Under no circumstances may any art purchased from or made by me, including but not limited to adoptables and commissions, be sold or traded as non-fungible tokens on any marketplace; nor may my work be sold using ANY blockchain system.-Under no circumstances may any art purchased or made by me, including but not limited to adoptables and commissions, be used as training data for "Artificial Intelligence" models of any kind. Any models trained on my work have been done without my consent, and may be subject to litigation.Non-commercial Custom Design Work
-Character, outfit or prop designs, also known as “Adoptables”, may have specific guidelines attached to their purchase (can/can't edit artwork, etc.) These will be attached to the ads where the design is purchased.
-All versions of the artwork, even if they're edited later, must have the original artwork attributed to me in some form.
-Using best judgement, if the character design is recognizably my design in further non-commercial artworks by other artists, design credit is greatly appreciated.
-As the artist I retain copyright on the original artwork, and I may use it to promote my work even as the design is owned by the buyer.
